"I've never seen the IOU note and neither did I agree to sign it. At the age of 12, I was too young to understand such a thing." Xiaozhao said.
Xiaozhao filed a complaint with the Minhang Procuratorate which quickly launched a team to investigate the case.
The team found that although Xiaozhao was listed as a co-defendant in the mediation letter, she was not notified of the mediation. Furthermore, she neither appeared in court nor was she legally represented by a third party.
More importantly, the loans involved were all used for investment in the company founded by her father and never for family life or Xiaozhao's education expenses.
Li, the creditor, realized that Zhao was using a house he co-owned with his wife and daughter as
collateral, thus he asked Zhao to include the names of his wife and daughter to make sure that he gets full ownership of the house in case Zhao could not pay the money back.
The team concluded that Xiaozhao as a minor, was put in a debt agreement by her guardian, who was supposed to always be in her interest and not otherwise. It suggested the court nullify the mediation agreement and start a new one.
After months, the new mediation was settled and it removed Xiaozhao's name as the co-defendant and her consumption restrictions were lifted.
